Frequently Asked Questions

A business license is an annual tax for doing business within the City limits of Gilroy. The City of Gilroy Municipal Code requires that you obtain a license when you conduct any business activity within the City, even if your business is located OUTSIDE the City limits or you have a business license from another City. Any business based in the City must have a license as well. This includes home occupations, transient businesses (carts, door-to-door sales), and out of town businesses such as contractors and construction companies.

Conducting business in the City without a license can result in citations and fines. The business license is not transferable. Relocation, expansion, change in owner, change in name, change in type of business, all require a new business license application.

• If you handle food, including restaurants, bakeries, markets, grocery stores, or even a candy store that sells bulk candy, you need to have a valid and current Health Permit. If you do not have one, please contact Santa Clara County Environmental Health at 408-918-3400 to obtain instructions on the kinds of requirements, inspections and/or permits required.

• If using a fictitious name or DBA, contact the Santa Clara County Clerk’s Office.

• If you buy or sell tangible goods, contact the State Board of Equalization.

• If you need an employer tax ID, contact the I.R.S. and Franchise Tax Board.

Fire/CUPA Fees are due at the same time as your business license renewal period.
